Welcome to the Lunar Guide app, owned and operated by 1117 Productions LLC and Chi Alexander (referred to as "we," "us," or "our"). Lunar Guide is a horoscope voice journaling application that provides personalized astrological guidance through an AI-powered feature called the "Spirit Guide." By accessing or using our app, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the app.
1. Description of Services
Lunar Guide offers a platform for personal astrology-based journaling and guidance. Key features of the service include:
Voice Journaling: You can record private voice notes about your thoughts, feelings, and experiences. These entries are stored securely and are not shared publicly. They are used solely to provide you with personalized content and to improve our services.
Astrological Insights: Based on information you provide (such as your birthdate and journal entries), the app delivers personalized horoscope readings and insights.
AI "Spirit Guide": The app's Spirit Guide feature uses artificial intelligence to analyze your voice or text journal entries and generate customized guidance or reflective prompts. This AI interaction is intended for informational and entertainment purposes only and is not a substitute for professional advice (see Section 5.2).
User Accounts: Users create personal accounts to save their journal entries, preferences, and purchase credits or subscriptions for premium features. Account creation and login can be done via email/password or third-party sign-in (e.g., Google).
Premium Features: While the app provides some content for free, advanced features (such as in-depth Spirit Guide sessions or exclusive astrological content) may require in-app purchases or an active subscription (see Section 3).
Our goal is to provide a safe, insightful, and enjoyable experience for users aged 18 and above. All content and guidance provided by Lunar Guide is meant to support personal reflection and enjoyment. It should not be relied upon for critical decisions or as professional counseling.
2. Use of the App
2.1. Eligibility and Account Registration
You must create an account to access most features of the Lunar Guide app. When registering, you agree to:
Provide Accurate Information: You will provide truthful, current, and complete information (such as a valid email address and, if requested, your name or birthdate). You will update your information if it changes, so we can maintain accurate records.
Age Requirement: You must be at least 18 years old to use the Lunar Guide app. By creating an account and using the app, you confirm that you are 18 or older. The app is not intended for users under 18, and we do not knowingly allow children to use the service.
Account Security: You are responsible for maintaining the confidentiality of your login credentials. Do not share your password or account access with others. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately at support@lunarguideapp.com.
2.2. User Responsibilities
By using Lunar Guide, you agree to use the app in a considerate and lawful manner. You must not:
Misuse the App: Engage in any activity that could harm or disrupt the app's functioning or other users' experience. This includes attempting to hack the app, introduce viruses or malicious code, perform reverse engineering, or exploit any part of the service.
Inappropriate Content: Upload or record any content in your voice notes that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable. Even though your journal entries are private, we reserve the right to investigate and take action (including account termination or law enforcement notification) if we become aware of content or behavior that violates these terms or applicable laws.
Respect Intellectual Property: Use the app in a way that infringes on any third party's intellectual property or privacy rights. (For example, do not use the app to store or share copyrighted material that you do not have the right to use.)
You are responsible for your own conduct and any data, text, or recordings that you input into the app. We are not obligated to monitor your private content, but we may do so to investigate or address any suspected violations of these Terms or unlawful behavior.
2.3. Account Usage Guidelines
One Account Per User: You should register and maintain only one account for your personal use. Creating multiple accounts to bypass limitations, abuse promotions, or for any deceptive purpose is prohibited.
Personal Use: The Lunar Guide app is offered for your personal, non-commercial use. You agree not to resell, distribute, or exploit the app or its content for any commercial purpose without our explicit permission.
No Impersonation: Do not impersonate any person or entity or falsely state or misrepresent yourself (for example, don't create an account using someone else's name or personal details without authorization).
By adhering to these responsibilities and guidelines, you help us maintain a positive and safe environment for all users.
3. Purchases, Credits, and Payments
Lunar Guide offers premium content and features that can be accessed through a credit system or via subscription plans. By making a purchase or subscribing, you agree to the pricing, payment, and billing policies outlined below.
3.1. Credit System
Some features of the app (for example, detailed Spirit Guide sessions or special astrological reports) operate on a credit-based system:
Purchasing Credits: You may buy credits through in-app purchases. Each credit can be used to unlock or access specific premium features as described in the app.
Usage of Credits: The app will clearly indicate how many credits are required for a given premium feature or content. Once used, credits are deducted from your account.
Payment Processing: Purchases of credits are processed securely via Stripe (our third-party payment processor). All transactions use encryption and secure protocols. We do not store your full payment card information on our servers (see Privacy Policy for details on payments).
Credits Expiration: Purchased credits do not expire and will remain in your account for use at any time, unless otherwise stated at the time of purchase or as required by applicable law. (If we ever implement credit expiration or a maximum carry-over, we will disclose this clearly.)
3.2. Subscription Plans
We may offer subscription plans (for example, a monthly or annual membership) that provide enhanced or unlimited access to premium features:
Subscription Benefits: Subscribers might receive a set number of credits per month, unlimited use of certain features, ad-free experience, or other exclusive benefits as described in the app at the time of subscription.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled at least 24 hours before the next renewal date. Your chosen payment method will be charged on a recurring basis (e.g., each month) without further authorization, until you cancel.
Managing Subscriptions: You can manage or cancel your subscription at any time. If you subscribed through our website or directly in the app (using Stripe), you may cancel through the app's account settings or by contacting our support. If you subscribed through a mobile app store (such as Apple App Store or Google Play), you must cancel through that store's subscription management settings.
Cancellation Policy: If you cancel a subscription, you will retain access to premium features until the end of the current paid period. The subscription will not renew after that period ends. No pro-rated refunds are provided for the remaining portion of a billing cycle when you cancel; the cancellation will take effect at the next renewal date.
3.3. Payment and Refund Policy
Payment Methods: By providing a payment method (such as a credit card or app store account credentials), you represent that you are authorized to use that payment method and you authorize us (or our designated payment processor) to charge the full amount of your purchase (credits or subscription fees) to that payment method.
All Sales Final: All purchases of credits or subscription fees are final and non-refundable. We do not offer refunds or credits for any unused services, partial subscription periods, or unused credits, except as expressly stated in these terms or required by law.
Technical Issues with Credits: If you experience an issue where you purchased credits or a subscription and did not receive the benefits (for example, credits not appearing in your account), please contact us at support@lunarguideapp.com. Upon verification of the issue, we may, at our discretion, provide the missing credits or otherwise ensure you receive what you paid for. This will be our sole responsibility in such cases.
Third-Party Purchase Platforms: If purchases are made through a third-party platform (like Apple App Store or Google Play Store), any billing disputes or refund requests may need to be handled in accordance with that platform's policies. We have limited ability to process refunds or cancellations for purchases made through third-party app stores.
Price Changes: We reserve the right to adjust pricing for our credits or subscription plans. If the price of your subscription changes, we will notify you in advance. Price changes for subscriptions will not apply retroactively and generally will become effective at the start of the next billing period. If you do not agree to a price change, you may cancel the subscription before the new price takes effect.
By making in-app purchases or subscribing, you acknowledge that you have read and understood these payment terms.
3.4 No-Refund Policy
All sales are final. Due to the instant-delivery nature of digital credits, subscriptions, and AI-generated content, we do not offer refunds or pro-rated credits once a purchase is completed, except where required by law. If technical issues prevent you from receiving what you paid for, we'll either (a) deliver the missing item or (b) issue a store credit — our choice, case-by-case. This policy applies to in-app purchases, web purchases, and any subscription renewals processed through Stripe or mobile app stores.
4. Prohibited Activities
We are committed to maintaining a secure and respectful environment for all users. You agree NOT to engage in any of the following prohibited activities:
4.1. Abuse, Exploitation, and Technical Misuse
Hacking and Security Attacks: You must not attempt to interfere with or undermine the security or proper functioning of the app. This includes hacking, scanning or testing the vulnerability of our systems, introducing viruses, worms, malware, or any other destructive code.
Unauthorized Access: Do not access (or attempt to access) any part of the app or its systems by any means other than the interfaces we provide. This means you should not attempt to gain unauthorized access to other users' accounts, data, or to non-public portions of the app.
Automated Use: You may not use any automated system (such as scripts, bots, or scrapers) to access the app for any purpose without our express permission. Normal indexing by search engines is allowed (for public web pages, if any), but using automation to extract data or to place undue load on our servers is prohibited.
4.2. Unlawful or Inappropriate Use
Illegal Activities: You must not use the Lunar Guide app for any unlawful purpose or in furtherance of illegal activities. This includes using the app to plan or engage in criminal conduct or to violate any applicable local, state, national, or international law or regulation.
Harassment or Harm: You must not use the app to harass, threaten, bully, or harm others. Any content you record or any interaction with our AI or support staff must be free of hate speech, discrimination, or encouragement of violence or self-harm. Although your voice journal entries are private, if such content comes to our attention (for example, through a support request or as part of our AI moderation processes), we reserve the right to take action.
Infringing Content: Do not upload or record content that violates the intellectual property rights or privacy rights of others. This includes sharing personal information about someone else without their consent, or recording copyrighted material (like music, book passages, or third-party voice recordings) that you do not have the right to use.
No Public Posting: The app does not have public forums or content sharing features for user-generated content. As such, using the app to disseminate spam, advertisements, or other unsolicited messages to other users is not applicable and is not permitted through any alternate means.
If you engage in any of these prohibited activities, we may take action including issuing warnings, removing or disabling offending content, suspending or terminating your account (Section 6), and, if necessary, reporting you to law enforcement.
5. AI Services and Disclaimers
Lunar Guide incorporates artificial intelligence to provide personalized guidance. It's important for you to understand how this works and its limitations.
5.1. AI Processing and User Consent
Use of AI ("Spirit Guide"): When you use the Spirit Guide feature or any AI-driven functionality in the app, the content you provide (such as the transcribed text of your voice notes or questions you ask the AI) is sent to our AI service providers (for example, OpenAI and Anthropic's Claude) to generate a response. By using these features, you consent to this processing of your content. We do not use the audio of your voice directly with these AI providers; typically, your voice notes are converted to text first, and that text is analyzed.
Data Handling: Our AI providers will receive only the information needed to generate your requested guidance. They do not receive your account details, password, or other unrelated personal information. (For more details on what information is shared and how it's protected, see our Privacy Policy.)
Quality of AI Responses: We strive to ensure the AI provides helpful and relevant astrological insights. However, AI technology is not perfect. The Spirit Guide may occasionally produce content that is incorrect, nonsensical, or inappropriate. We use content filters and ongoing improvements to minimize such occurrences, but we cannot guarantee that every AI-generated response will be accurate or suitable.
User Feedback: If you receive an AI response that you believe is erroneous or offensive, please disregard it and feel free to let us know through our support channels. User feedback helps us refine our AI models and filters. You will not be penalized for the content the AI generates in response to your prompts, but you must still adhere to the usage guidelines in how you prompt or use the AI.
5.2. Informational Purposes Only (No Professional Advice)
Not Professional Advice: All guidance, messages, and insights provided by Lunar Guide – including those from the Spirit Guide AI and any human-curated content – are for informational and entertainment purposes. The app's content is based on astrology and algorithmic analysis of your input. It is not a substitute for professional advice. Specifically:
- Medical or Mental Health: We are not healthcare professionals. Any suggestions or reflective prompts given by the app should not be treated as medical or mental health advice. Always seek the guidance of a qualified healthcare provider for questions regarding a medical or mental health condition.
- Financial or Legal: We do not provide financial, legal, or investment advice. Any financial or career-related guidance from the app is general in nature. Consult a licensed professional for financial planning, legal matters, or other expert advice.
- Any Other Professional Field: You should not make significant life decisions (such as decisions regarding personal relationships, major purchases, etc.) based solely on information from this app.
User Discretion: You understand and agree that any actions you take based on information or guidance from the app are taken at your own discretion and risk. We make no guarantees about the effectiveness, accuracy, or suitability of the astrological or AI-provided insights for your particular situation.
No Therapeutic or Emergency Use: The Lunar Guide app is not a crisis or therapeutic service. If you are experiencing a personal crisis, mental health emergency, or any situation requiring urgent attention, do not rely on the app – instead, seek help from qualified professionals or emergency services.
By acknowledging these points, you agree that you will use the information provided by the app responsibly and that you understand its limitations.
6. Account Termination and Suspension
6.1. By Us (Termination for Cause)
We reserve the right to suspend or terminate your account at our discretion if we have reason to believe that you have violated these Terms or engaged in any activities that are illegal or that could harm us, the app, or other users. Circumstances that may lead to termination include (but are not limited to):
- Violations of Terms: Breaching any of the rules outlined in Sections 2, 3, or 4 (e.g., engaging in prohibited activities, failing to comply with payment obligations, etc.).
- Fraudulent or Illegal Use: Using the app for fraudulent purposes, or in a manner that violates any law or regulation.
- Interference with Services: Actions that interfere with the normal operation of the app, security breaches, or attempts to gain unauthorized access to systems.
- Risk of Harm or Liability: Behavior that poses a risk of harm to other users, third parties, or to our interests.
If we suspend or terminate your account:
- We will generally attempt to notify you at the email address associated with your account, describing the reason for termination or suspension, unless we are prevented by law or if we determine in our discretion that providing notice could result in further harm.
- During a suspension, you may not be able to access your account or any content (including voice notes or credits) stored in it. During termination, your account will be closed permanently.
- Accounts terminated for cause will forfeit any unused credits or remaining subscription time without entitlement to a refund, and you may lose access to any data associated with the account (subject to our data retention policies and your rights under the Privacy Policy).
6.2. By You (Voluntary Termination)
You have the right to stop using Lunar Guide at any time. If you wish to delete your account and personal data:
- You can contact us at support@lunarguideapp.com with a request to delete your account. For security, we may require verification (such as a confirmation from the registered email) before deleting the account.
- Account deletion is irreversible. Once deleted, your voice entries, account info, and other data will be removed or anonymized in accordance with our Privacy Policy's Data Retention section. (Note: Data may persist in secure backups for a short period, and we may retain certain information if required by law.)
- If you have an active subscription and you plan to delete your account, you should cancel the subscription first to avoid further billing (see Section 3.2 on managing subscriptions). Deleting the app or your account does not automatically cancel a subscription purchased through an app store – you must do that through the store.
Termination of your account (by you or by us) will not waive or affect any rights or responsibilities that arose prior to the date of termination. Sections of these Terms which by their nature should survive termination (such as intellectual property rights, disclaimers, limitation of liability, dispute resolution, etc.) will remain in effect even after your account is closed.
7. Third-Party Services
The Lunar Guide app integrates with or utilizes several third-party services to provide functionality and support our operations. By using the app, you acknowledge and agree to the involvement of these third parties and to abide by their respective terms of service and privacy policies as applicable. Key third-party services used in Lunar Guide include:
Google Services: We use Google for user authentication (e.g., "Sign in with Google") and to integrate optional features such as Google Tasks or Google Calendar into the app. If you choose to connect your Google account, you agree to Google's Terms of Service. Google's Privacy Policy will apply to the data they handle (e.g., your Google profile or calendar data).
Firebase (Google Cloud): Lunar Guide is built on Google's Firebase platform, which provides our database, cloud storage, and hosting. All your data (account information, voice note content, etc.) is stored on Firebase's servers. Firebase's security and infrastructure help protect your data. By using our app, you agree to Google Firebase's terms.
OpenAI and Anthropic (AI Services): Our Spirit Guide feature relies on AI models developed by third parties (for example, OpenAI and Anthropic's Claude). When you input data for an AI analysis, that data is sent to these providers to generate a response. Use of the app signifies your agreement with OpenAI's and Anthropic's terms of service when they process your content. (These providers are under strict obligations to use your data only to provide the requested service and not for their own purposes.)
Eleven Labs: We use Eleven Labs services for certain voice processing features (such as text-to-speech or other voice AI features). By using features powered by Eleven Labs, you also agree to Eleven Labs' terms of service. We only send the necessary data (for example, text to be synthesized into audio, or audio to be transcribed) to Eleven Labs for processing.
Stripe: All payments in Lunar Guide (purchasing credits or subscriptions) are processed via Stripe, a secure payment processor. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. We do not handle or store your sensitive payment details (like full credit card numbers); Stripe processes that information.
Analytics and Tracking Tools: We utilize third-party analytics and tracking services to understand app usage and improve our product:
- Google Analytics: Provides insight into user interactions (e.g., which features are most used, overall usage statistics).
- Microsoft Clarity: May record anonymized information about how you use our app (such as taps, swipes, or how you navigate screens) to help us improve design and fix usability issues. These session recordings do not include any of your personal voice note content, but focus on interface usage patterns.
- Advertising Pixels (Facebook, TikTok, Instagram, Snapchat): These tools help us with our marketing and advertising efforts by letting us know, in aggregate, how users find our app and how effective our ads are. They may track events like app installs or visits to our website. By using the app or site, you agree to the data practices of these platforms as they relate to pixel tracking.
We carefully select our third-party partners and strive to share only the minimum necessary data with them for the app's functionality. However, we do not control these third-party services and their operations. Therefore:
- Any use of third-party services is subject to the terms and policies of those providers. We encourage you to review the privacy policies and terms of service of Google, OpenAI, Anthropic, Eleven Labs, Stripe, Microsoft, Facebook, TikTok, etc., to understand how they handle your information.
- We are not liable for any issues or liabilities arising from the services provided by third parties. If you encounter an issue with a third-party service (for example, a problem with a Stripe payment or a Google sign-in issue), we will do our best to assist or facilitate a solution, but the ultimate resolution may depend on the third party.
Your acceptance of these Terms constitutes your acknowledgment that third-party services are integral to the Lunar Guide app and that your data may be processed by them as described. For more details on data sharing with third parties, please see our Privacy Policy.
8. Email Communications and Marketing
By creating an account with Lunar Guide, you consent to receive emails from us as part of your use of the service. These emails will fall into two categories: operational communications and promotional communications.
Operational Emails: We may send you emails for account verification, password recovery, purchase confirmations, receipts, technical notices, security alerts, and support responses. These are necessary for the functioning of the service and are not promotional in nature. You cannot opt out of receiving essential operational emails related to your own account and transactions, as they are necessary for us to provide our services to you.
Promotional Emails: We may also send you newsletters or promotional emails to inform you about new features, content, special offers, or other news about Lunar Guide that we think you'd find valuable.
Consent and Opt-Out: By default, creating an account indicates your consent to receive these promotional messages. However, you have the right to opt out at any time. Each marketing email will include an "unsubscribe" link at the bottom. By clicking that link, you can stop future promotional emails. Alternatively, you can adjust your email preferences in the app (if such setting is available) or contact support to be removed from marketing lists.
Third-Party Marketing: We will not share your email with third-party marketers without your explicit consent. (We do not currently send third-party advertisements; any marketing emails will be about our own app and services.)
We respect your preferences regarding communications. Please note that changes to your email subscription preferences may take a few days to process. Even after you opt out of promotional messages, you will continue to receive necessary account and transaction-related emails.
9. Intellectual Property
All content and materials within the Lunar Guide app are protected by intellectual property laws. This includes, but is not limited to, the app's software code, design, graphics, logos, trademarks, service marks, features, information, and content provided through the app (collectively, "App Content").
Ownership: Except for content that you provide (such as your personal journal entries), 1117 Productions LLC (and its licensors, where applicable) retains all rights, title, and interest in and to the App Content. The Lunar Guide name and logo are trademarks of 1117 Productions LLC. Other product and company names mentioned in the app may be trademarks of their respective owners.
Limited License to You: We grant you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable license to access and use the app and App Content for your personal, non-commercial use only, as intended through the normal functionality of the service and in accordance with these Terms. This license is provided solely to allow you to use and enjoy the app's benefits as permitted by these Terms.
Restrictions: You agree not to reproduce, duplicate, copy, sell, trade, resell, distribute, or exploit any portion of the app or App Content without our prior written permission. This means you cannot, for example, scrape or extract our horoscope content to post elsewhere, use our trademarks in a way that confuses others, or create derivative applications based on our app.
9.3 Licensed Stock Assets
Lunar Guide occasionally incorporates photographs, illustrations, and video loops sourced under license from Adobe Stock (and similar royalty-bearing libraries) for in-app artwork, marketing pages, and social media creatives. • These assets remain the copyrighted property of their respective creators and licensors. • Your right to view them is non-transferable and personal; you may not download, redistribute, edit, or commercialize those images outside the Lunar Guide environment unless Adobe's license or the original artist specifically allows it. • If you believe a stock asset has been used outside the scope of its license, contact us at copyright@lunarguideapp.com and we'll investigate or swap it out promptly.
User Content: You retain ownership of any original content you upload or record (such as your voice journal entries). However, by using the app and submitting content, you grant us a limited license to use that content as needed to provide the service to you. For example, we have your permission to store your voice notes on our servers, back them up, display them to you within the app, and process them through the AI to generate guidance for you. We will not share your personal journal content with other users or make it public. (See our Privacy Policy for details on how user content is handled.)
Feedback: If you send us any feedback, ideas, or suggestions regarding the app ("Feedback"), you acknowledge that such Feedback is not confidential and you grant us the right to use it without restriction or payment to you. We may use Feedback to improve our product and services.
All rights not expressly granted to you in these Terms are reserved by 1117 Productions LLC. Unauthorized use of any App Content or intellectual property may violate copyright, trademark, and other laws. We will enforce our intellectual property rights to the full extent of the law.
10. Limitation of Liability
To the fullest extent permitted by applicable law, 1117 Productions LLC, Chi Alexander, and our respective officers, directors, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or exemplary damages that result from or are related to your use of (or inability to use) the Lunar Guide app or any App Content. This includes, but is not limited to:
- Loss of Data or Content: any loss, deletion, or damage to your voice recordings, journal entries, or other data.
- Loss of Goodwill or Profits: any lost business, opportunities, revenue, or anticipated savings.
- Service Interruptions: any downtime or inaccessibility of the app, or bugs, viruses, or the like that are transmitted to or through our service by any third party.
- Third-Party Conduct: conduct or content of any third party, including any third-party applications or services integrated with the app.
- Decisions You Make: any decisions or actions you take in reliance on the astrological guidance or other information provided by the app (as explained in Section 5.2, our content is for informational purposes and not professional advice).
These limitations apply even if we have been advised of the possibility of such damages. You assume full responsibility for your use of the app. Your sole remedy against us for dissatisfaction with the service or any content is to stop using the app and, if applicable, delete your account. Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, some of the above limitations may not apply to you. In those cases, our liability will be limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless 1117 Productions LLC, Chi Alexander, and each of our affiliates, officers, agents, partners, and employees (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) that arise out of or are related to:
- Your Use of the App: any activity in which you engage on or through the Lunar Guide app, including the content of voice notes or other data you submit.
- Violation of These Terms: any breach by you of these Terms and Conditions or of any representation or warranty contained herein.
- Violation of Law or Rights: your violation of any law, regulation, or the rights of any third party (for example, if you use the app to infringe someone else's copyright or if your journal content unlawfully defames someone and they take action against us).
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate in such defense. This indemnity obligation will survive the termination of your account and these Terms.
12. Service Availability and Changes
We strive to provide a reliable service, but we do not guarantee that the Lunar Guide app will be available 100% of the time or that it will be free from errors or interruptions.
Downtime and Maintenance: There may be times when the app is unavailable due to scheduled maintenance or upgrades, or due to unforeseen outages or technical issues. We will attempt to schedule maintenance during low-usage times and, when possible, to notify users in advance through the app or email. However, we may not always be able to inform you beforehand.
No Liability for Interruptions: You agree that we shall not be liable for any losses or inconvenience suffered due to any downtime, slow performance, or errors in the app's operation. This includes any issues originating from our third-party providers (for example, if Firebase or OpenAI services experience outages that impact our app).
Feature Changes: We reserve the right to change, suspend, or discontinue any aspect of the app at any time, including altering features, imposing usage limits, or terminating the app entirely. We may also update the software, which could modify the app's functionality. We will endeavor to notify users of major changes that significantly affect the use of the app.
Beta Features: If we release features labeled as "beta" or "experimental," those are provided on an as-is and as-available basis for testing and feedback. These features might be changed, suspended, or removed at our discretion.
Your continued use of the app after any changes to services or features indicates your acceptance of those changes. If you do not agree or are dissatisfied with any changes, your sole remedy is to discontinue use of the app.
13. Dispute Resolution
We value our users and aim to address any concerns without the need for formal legal action. Before initiating any legal claim, please try contacting us at support@lunarguideapp.com so we can attempt to resolve the issue amicably. If a dispute arises that we cannot resolve informally, the following provisions will apply:
Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Lunar Guide app shall be resolved by binding arbitration, rather than in court, except for certain exceptions noted below. Arbitration is more informal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury, allowing for more limited discovery than in court and subject to limited review by courts.
Arbitration Procedures: The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and, where applicable, its Supplementary Procedures for Consumer-Related Disputes. The arbitration will be conducted in English by a single, neutral arbitrator.
Location: The arbitration hearing shall take place in Salt Lake City, Utah, USA, unless we both agree on an alternative location. If your claim is for $10,000 or less and you are unable to travel to Utah, you may choose to have the arbitration conducted by telephone or based on written submissions.
Arbitration Costs: Each party will be responsible for their own attorneys' fees and costs. Arbitration filing fees and arbitrator's fees shall be allocated as required by the AAA's rules, or as determined by the arbitrator (subject to applicable law).
Exceptions to Arbitration: Both you and we retain the right to: (a) bring an individual claim in small claims court if it qualifies; and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent (or enjoin) the infringement or misappropriation of intellectual property.
Class Action Waiver: You and 1117 Productions LLC agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis and not as a class action or collective action, and that you shall not seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated without the express consent of all parties. By agreeing to these Terms, you are waiving any right to participate as a plaintiff or class member in any purported class or representative proceeding.
Jury Trial Waiver: If for any reason a claim proceeds in court rather than through arbitration, you and we each waive any right to a jury trial.
Notice to California Residents: Under California Civil Code Section 1789.3, users in California are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
By agreeing to arbitration, you understand that you are giving up certain rights to participate in courts and class actions, as explained above. This Dispute Resolution section shall survive any termination of these Terms or your account.
14. Governing Law and Jurisdiction
These Terms and Conditions and any dispute arising out of or relating to them or the use of the app are governed by the laws of the United States and the State of Utah, without regard to its conflict of law principles.
Jurisdiction: Except where arbitration is required as above, you agree that any legal actions or proceedings related to these Terms (including any arbitration awards or small claims matters, if applicable) will be filed and conducted in the state or federal courts located in Salt Lake County, Utah, USA. You consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such claim or action.
International Use: We make no representation that the app or its content is appropriate or available for use in locations outside of the United States. If you choose to access or use the Lunar Guide app from jurisdictions outside the U.S., you do so at your own initiative and are responsible for compliance with any local laws applicable to your use. You agree that you will not use the app in any country or in any manner prohibited by U.S. laws, export control laws, or any other applicable laws.
Limitations: Any claim or cause of action arising out of or related to use of the app or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred. This limitation may not apply in certain jurisdictions, in which case it shall apply to the maximum extent permitted.
15. Changes to These Terms
We may update or modify these Terms and Conditions from time to time. When we do, we will revise the "Effective Date" at the top of the Terms. For significant changes, we will make reasonable efforts to notify you by one or more of the following: posting a notice within the app, posting an announcement on our website, or sending an email to the address associated with your account.
Acceptance of Changes: By continuing to use the Lunar Guide app after the updated Terms have been posted (and after any applicable notice period), you are indicating that you agree to be bound by the revised Terms. If you do not agree to any changes, you must stop using the app and, if you have an account, you should delete your account or contact us to deactivate it.
Reviewing Updates: We encourage you to review these Terms periodically to stay informed about our rules and your obligations. You can always find the latest version of the Terms and Conditions on our website (usually at the "Terms" or "Terms and Conditions" link).
Entire Agreement: These Terms (along with the Privacy Policy and any additional guidelines or rules posted in the app) constitute the entire agreement between you and us regarding the use of Lunar Guide. They supersede any prior agreements or communications between you and us related to the app. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
