Welcome to the Lunar Guide app, owned and operated by 1117 Productions LLC and Chi Alexander (referred to as "we," "us," or "our"). Lunar Guide is a horoscope voice journaling application that provides personalized astrological guidance through an AI-powered feature called the "Spirit Guide." By accessing or using our app, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the app.

1. Description of Services

Lunar Guide offers a platform for personal astrology-based journaling and guidance. Key features of the service include:

Voice Journaling: You can record private voice notes about your thoughts, feelings, and experiences. These entries are stored securely and are not shared publicly. They are used solely to provide you with personalized content and to improve our services.

Astrological Insights: Based on information you provide (such as your birthdate and journal entries), the app delivers personalized horoscope readings and insights.

AI "Spirit Guide": The app's Spirit Guide feature uses artificial intelligence to analyze your voice or text journal entries and generate customized guidance or reflective prompts. This AI interaction is intended for informational and entertainment purposes only and is not a substitute for professional advice (see Section 5.2).

User Accounts: Users create personal accounts to save their journal entries, preferences, and purchase credits or subscriptions for premium features. Account creation and login can be done via email/password or third-party sign-in (e.g., Google).

Premium Features: While the app provides some content for free, advanced features (such as in-depth Spirit Guide sessions or exclusive astrological content) may require in-app purchases or an active subscription (see Section 3).

Our goal is to provide a safe, insightful, and enjoyable experience for users aged 18 and above. All content and guidance provided by Lunar Guide is meant to support personal reflection and enjoyment. It should not be relied upon for critical decisions or as professional counseling.

2. Use of the App

2.1. Eligibility and Account Registration

You must create an account to access most features of the Lunar Guide app. When registering, you agree to:

Provide Accurate Information: You will provide truthful, current, and complete information (such as a valid email address and, if requested, your name or birthdate). You will update your information if it changes.

Age Requirement: You must be at least 18 years old to use the Lunar Guide app. By creating an account, you confirm that you are 18 or older. The app is not intended for users under 18.

Account Security: You are responsible for maintaining the confidentiality of your login credentials. Do not share your password or account access with others. You are responsible for all activities that occur under your account. If you suspect any unauthorized use or a security breach, notify us immediately at support@lunarguideapp.com.

2.2. User Responsibilities

By using Lunar Guide, you agree to use the app in a considerate and lawful manner. You must not:

Misuse the App: Engage in any activity that could harm or disrupt the app's functioning or other users' experience. This includes hacking, introducing viruses or malicious code, performing reverse engineering, or exploiting any part of the service.

Inappropriate Content: Upload or record any content in your voice notes that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable. Even though your journal entries are private, we reserve the right to investigate and take action (including account termination or law enforcement notification) if we become aware of content or behavior that violates these terms or applicable laws.

Respect Intellectual Property: Use the app in a way that infringes on any third party's intellectual property or privacy rights.

You are responsible for your own conduct and any data, text, or recordings you input into the app. We are not obligated to monitor your private content, but we may do so to investigate or address suspected violations of these Terms or unlawful behavior.

2.3. Account Usage Guidelines

One Account Per User: You should register and maintain only one account for your personal use. Creating multiple accounts to bypass limitations, abuse promotions, or for deceptive purposes is prohibited.

Personal Use: The Lunar Guide app is offered for your personal, non-commercial use. You agree not to resell, distribute, or exploit the app or its content for any commercial purpose without our explicit permission.

No Impersonation: Do not impersonate any person or entity or falsely state or misrepresent yourself.

By adhering to these responsibilities and guidelines, you help us maintain a positive and safe environment for all users.

3. Intellectual Property

3.1. Ownership of the App

1117 Productions LLC is the sole owner of the Lunar Guide application, including all of its software code (front-end and back-end), architecture, algorithms, databases, design systems, UI/UX elements, feature logic, and all related intellectual property. The Lunar Guide name, logo, brand identity, and all associated trademarks and service marks are the exclusive property of 1117 Productions LLC. No rights in or to the app, its technology, or its brand are transferred to you by virtue of your use of the service.

All App Content — including but not limited to horoscope text, Spirit Guide responses, audio clips, graphics, illustrations, animations, iconography, written content, and data compilations — is protected by copyright, trademark, trade secret, and other applicable intellectual property laws. 1117 Productions LLC (and its licensors, where applicable) retains all rights, title, and interest in and to the App Content.

Limited License to You: We grant you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable license to access and use the app and App Content solely for your personal, non-commercial use and as intended through the normal functionality of the service. This license is limited to what is expressly permitted by these Terms and does not convey any ownership interest.

Restrictions: You agree not to reproduce, duplicate, copy, sell, trade, resell, distribute, create derivative works from, decompile, disassemble, or reverse engineer any portion of the app or App Content without our prior written permission.

Licensed Stock Assets: Lunar Guide may incorporate photographs, illustrations, and video loops sourced under license from Adobe Stock or similar royalty-bearing libraries. These assets remain the property of their respective creators and licensors. Your right to view them is non-transferable and personal; you may not download, redistribute, edit, or commercialize those assets outside the Lunar Guide environment. If you believe a stock asset has been used outside the scope of its license, contact us at copyright@lunarguideapp.com.

Feedback: If you send us feedback, ideas, or suggestions ("Feedback"), you acknowledge that such Feedback is not confidential and you grant us an irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate it into the app and services without restriction or payment to you.

3.2. User Content License Grant

You retain full ownership of any original content you create, upload, or record within the app, including your voice journal entries and any text you input ("User Content").

By submitting User Content, you grant 1117 Productions LLC a limited, non-exclusive, royalty-free, sublicensable (to our service providers only), worldwide license to:

Store, reproduce, and back up your User Content on our servers and cloud infrastructure.
Display and play back your User Content to you within the app.
Transmit your User Content (in text-transcribed form) to our AI processing providers to generate personalized guidance at your direction.
Use your User Content to provide, maintain, and improve the service as described in our Privacy Policy.

This license is granted solely for the purpose of operating the service and is limited to what is strictly necessary for that purpose. We will not share your personal journal content publicly, sell it, or use it for any purpose beyond operating and improving the service you use. This license terminates when you delete the relevant User Content or when your account is deleted, subject to residual backup retention periods described in our Privacy Policy.

Representations: You represent that you own your User Content or have all necessary rights, licenses, and permissions to submit it and to grant us the license described above, and that doing so does not violate any third party's intellectual property, privacy, or other rights.

All rights not expressly granted to you in these Terms are reserved by 1117 Productions LLC.

4. Purchases, Credits, and Payments

Lunar Guide offers premium content and features accessible through a credit system or subscription plans. By making a purchase or subscribing, you agree to the pricing, payment, and billing policies outlined below.

4.1. Credit System

Purchasing Credits: You may buy credits through in-app purchases. Each credit can be used to unlock specific premium features as described in the app.

Usage of Credits: The app clearly indicates how many credits are required for a given premium feature. Once used, credits are deducted from your account.

Payment Processing: Purchases are processed securely via Stripe. All transactions use encryption and secure protocols. We do not store your full payment card information on our servers.

Credits Expiration: Purchased credits do not expire and will remain in your account unless otherwise stated at the time of purchase or as required by applicable law. If we ever implement credit expiration, we will disclose this clearly in advance.

Credits Upon Account Deletion: If you voluntarily delete your account or your account is terminated for cause, any unused credits will be forfeited and are not refundable. We strongly encourage you to use remaining credits before initiating account deletion.

4.2. Subscription Plans

Subscription Benefits: Subscribers may receive a set number of credits per month, unlimited use of certain features, ad-free experience, or other exclusive benefits as described in the app.

Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled at least 24 hours before the next renewal date. Your payment method will be charged on a recurring basis without further authorization until you cancel.

Managing Subscriptions: You may manage or cancel your subscription at any time through the app's account settings or by contacting support. If subscribed through an app store (Apple App Store or Google Play), cancellation must be made through that store's subscription management settings.

Cancellation Policy: If you cancel, you retain access to premium features until the end of the current paid period. No pro-rated refunds are provided for remaining subscription time; the cancellation takes effect at the next renewal date.

4.3. Payment and Refund Policy

Payment Methods: By providing a payment method, you represent that you are authorized to use it and authorize us (or our payment processor) to charge the full amount of your purchase.

All Sales Final: All purchases of credits and subscription fees are final and non-refundable, except as expressly stated in these Terms or as required by applicable law.

Technical Issues: If you purchased credits or a subscription and did not receive the benefits, contact us at support@lunarguideapp.com. Upon verification, we may, at our discretion, deliver the missing item or issue a store credit. This is our sole responsibility for such issues.

Third-Party Purchase Platforms: Purchases made through Apple App Store or Google Play are subject to those platforms' billing and refund policies. We have limited ability to process refunds for such purchases.

Price Changes: We reserve the right to adjust pricing with advance notice. Price changes for subscriptions take effect at the start of the next billing period. If you do not agree to a price change, you may cancel before the new price takes effect.

4.4. No-Refund Policy

All sales are final. Due to the instant-delivery nature of digital credits, subscriptions, and AI-generated content, we do not offer refunds or pro-rated credits once a purchase is completed, except where required by law. If technical issues prevent you from receiving what you paid for, we'll either (a) deliver the missing item or (b) issue a store credit — our choice, case-by-case. This policy applies to in-app purchases, web purchases, and subscription renewals processed through Stripe or mobile app stores.

5. Prohibited Activities

We are committed to maintaining a secure and respectful environment. You agree NOT to engage in any of the following prohibited activities:

5.1. Abuse, Exploitation, and Technical Misuse

Hacking and Security Attacks: You must not attempt to interfere with or undermine the security or proper functioning of the app. This includes hacking, scanning or testing system vulnerabilities without authorization, introducing viruses, worms, malware, or any destructive code.

Unauthorized Access: Do not access (or attempt to access) any part of the app or its systems other than through the interfaces we provide. Do not attempt to access other users' accounts or non-public portions of the app.

Automated Use: You may not use any automated system (scripts, bots, scrapers) to access the app for any purpose without our express permission.

5.2. Unlawful or Inappropriate Use

Illegal Activities: You must not use Lunar Guide for any unlawful purpose or to further illegal activities.

Harassment or Harm: You must not use the app to harass, threaten, bully, or harm others, or to produce content involving hate speech, discrimination, or encouragement of violence or self-harm.

Infringing Content: Do not upload or record content that violates the intellectual property or privacy rights of others.

If you engage in prohibited activities, we may issue warnings, remove or disable offending content, suspend or terminate your account, and report you to law enforcement where appropriate.

6. AI Services and Disclaimers

6.1. AI Processing and User Consent

Use of AI ("Spirit Guide"): When you use the Spirit Guide or any AI-driven functionality, the content you provide (transcribed text of your voice notes or typed prompts) is sent to our AI service providers (e.g., OpenAI, Anthropic) to generate a response. By using these features, you consent to this processing. We do not send the raw audio of your voice to AI providers; voice notes are converted to text first.

Data Handling: Our AI providers receive only the information needed to generate your requested guidance. They do not receive your account credentials or unrelated personal information. See our Privacy Policy for details on what is shared and how it is protected.

Quality of AI Responses: We strive to ensure the AI provides helpful and relevant astrological insights. However, AI technology is imperfect and may occasionally produce content that is incorrect, nonsensical, or inappropriate. We use content filters and ongoing improvements to minimize such occurrences, but we cannot guarantee the accuracy or suitability of every AI-generated response.

User Feedback: If you receive an AI response you believe is erroneous or offensive, please disregard it and let us know through our support channels. User feedback helps us refine our AI filters and models.

6.2. Informational Purposes Only — No Professional Advice; AI Accuracy Disclaimer

Not Professional Advice: All guidance, messages, and insights provided by Lunar Guide — including those from the Spirit Guide AI and any human-curated content — are for informational and entertainment purposes only. The app's content is based on astrology and algorithmic analysis of your input and is not a substitute for professional advice. Specifically:

Medical or Mental Health: We are not healthcare professionals. Nothing in the app constitutes medical or mental health advice. Always seek the guidance of a qualified healthcare provider for any medical or mental health concern.
Financial or Legal: We do not provide financial, legal, or investment advice. Consult a licensed professional for such matters.
Any Other Professional Field: Do not make significant life decisions (personal relationships, major purchases, etc.) based solely on information from this app.

AI Accuracy Disclaimer: The Spirit Guide and all AI-powered features in the app produce outputs that are probabilistic and may be inaccurate, incomplete, outdated, biased, or otherwise unreliable. Artificial intelligence systems can generate plausible-sounding content that is factually incorrect. You should not rely on AI-generated content for any decision of consequence. We expressly disclaim all liability for harm arising from reliance on AI-generated outputs. This disclaimer applies regardless of whether errors result from the AI model, its training data, how your input was processed, or any other cause.

User Discretion: You understand and agree that any actions you take based on information or guidance from the app are taken at your own discretion and risk.

No Therapeutic or Emergency Use: The Lunar Guide app is not a crisis or therapeutic service. If you are experiencing a personal crisis, mental health emergency, or any situation requiring urgent attention, do not rely on the app — seek help from qualified professionals or emergency services immediately.

7. Account Termination and Suspension

7.1. By Us (Termination for Cause)

We reserve the right to suspend or terminate your account at our discretion if we have reason to believe you have violated these Terms, engaged in illegal activities, or taken actions harmful to us, the app, or other users. Circumstances leading to termination include (but are not limited to):

Violations of Sections 2, 4, or 5 of these Terms.
Fraudulent or illegal use of the service.
Interference with the app's normal operation or security breaches.
Behavior posing a risk of harm or liability.

If we suspend or terminate your account:

We will generally attempt to notify you at your registered email address, unless prevented by law or unless notice would result in further harm.
During suspension, you may not be able to access your account, content, or credits. Upon termination, your account is permanently closed.
Accounts terminated for cause will forfeit all unused credits and any remaining subscription time without entitlement to a refund. Access to all account data (voice notes, preferences, history) will be removed pursuant to our Privacy Policy's data retention schedule.

7.2. By You (Voluntary Termination)

You have the right to stop using Lunar Guide at any time. To delete your account and personal data:

Contact us at support@lunarguideapp.com with a deletion request. We may require verification (such as a confirmation from your registered email) before deleting the account.
Account deletion is irreversible. Once deleted, your voice entries, account info, and other data will be permanently removed or anonymized within 30 days of your verified request, subject to our data retention obligations described in the Privacy Policy.
Credits Forfeiture: Voluntary account deletion results in forfeiture of all unused credits without a refund.
Subscription: Before deleting your account, cancel any active subscription to avoid further billing. Deleting the app or your account does not automatically cancel a subscription purchased through an app store — you must cancel through the store separately.

Termination (by you or by us) does not waive rights or responsibilities that arose before termination. Sections of these Terms that by their nature should survive termination — including intellectual property rights, user content license grant, disclaimers, limitation of liability, indemnification, and dispute resolution — will remain in effect after your account is closed.

8. Indemnification

You agree to indemnify, defend, and hold harmless 1117 Productions LLC, Chi Alexander, and each of our affiliates, officers, directors, agents, partners, contractors, and employees (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) that arise out of or are related to:

Your Use of the App: any activity in which you engage on or through Lunar Guide, including the content of voice notes or other data you submit.
Violation of These Terms: any breach by you of these Terms or any representation or warranty contained herein.
Violation of Law or Third-Party Rights: your violation of any law, regulation, or the rights of any third party (e.g., if you use the app to infringe someone's copyright, defame a third party, or violate their privacy).
User Content: any claim arising from or relating to User Content you submit, including claims that it infringes any third party's intellectual property or other rights.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate in such defense. This indemnity obligation survives termination of your account and these Terms.

9. Dispute Resolution

We value our users and aim to address concerns without formal legal action. Before initiating any legal claim, please contact us at support@lunarguideapp.com to attempt an informal resolution. If we cannot resolve the dispute informally within 30 days of your written notice, the following provisions apply.

9.1. Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Lunar Guide app, or the breach, termination, enforcement, interpretation, or validity thereof (including the determination of the scope or applicability of this agreement to arbitrate) shall be resolved by binding individual arbitration rather than in court, except as provided in Section 9.4 below.

You and 1117 Productions LLC each waive the right to a jury trial and the right to participate in a class action.

9.2. Arbitration Procedures

Administrator: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or its Commercial Arbitration Rules where the Consumer Rules do not apply. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879.

Arbitrator: The arbitration will be conducted by a single, neutral arbitrator selected in accordance with AAA rules. The arbitrator will have the authority to decide all issues, including threshold issues of arbitrability, except as otherwise specified here.

Location: The arbitration shall take place in Salt Lake City, Utah, USA. If your claim is for $10,000 or less and you cannot travel to Utah, you may elect to conduct the arbitration by telephone, video conference, or written submissions. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA's rules.

Language: All proceedings will be conducted in English.

Governing Rules: The arbitrator shall apply the substantive law of the State of Utah (without regard to conflict-of-laws principles) and applicable federal law. The arbitrator may award any remedy that would be available in a court of law, including injunctive relief on an individual basis.

Award: The arbitrator's decision will be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

9.3. Arbitration Costs

Each party is responsible for their own attorneys' fees and costs, subject to any right to recover fees or costs under applicable law. AAA filing fees will be allocated as required by the AAA's Consumer Fee Schedule. We will pay all AAA arbitration fees for claims of $10,000 or less unless the arbitrator determines the claim was frivolous. For claims exceeding $10,000, AAA fees will be split equally unless the arbitrator determines otherwise.

9.4. Exceptions to Arbitration

The following disputes are excluded from the arbitration requirement and may be pursued in court:

(a) Claims that qualify for small claims court, provided they are filed and remain in small claims court as individual (non-class) actions.

(b) Claims for injunctive or other equitable relief in a court of competent jurisdiction to prevent or enjoin the actual or threatened infringement, misappropriation, or violation of intellectual property rights, trade secrets, or other proprietary rights.

9.5. Class Action Waiver

You and 1117 Productions LLC each agree that any proceeding to resolve a dispute will be conducted solely on an individual basis and not as a class, consolidated, mass, or collective action, or as a private attorney general action. The arbitrator may not consolidate the claims of more than one person without the express written consent of all parties. If this class action waiver is found unenforceable as to any particular claim or request for relief, then that specific claim or request for relief shall be severed from arbitration and may be litigated in court, but the arbitration agreement shall continue to apply to all remaining claims.

9.6. Jury Trial Waiver

If for any reason a claim proceeds in court rather than through arbitration, you and 1117 Productions LLC each irrevocably waive the right to a jury trial. Any court proceedings will be conducted by a judge alone.

9.7. Notice to California Residents

Under California Civil Code Section 1789.3, users in California are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

This Dispute Resolution section survives any termination of these Terms or your account.

10. Third-Party Services

The Lunar Guide app integrates with several third-party services. By using the app, you acknowledge the involvement of these third parties and agree to abide by their respective terms of service and privacy policies. Key third-party services include:

Google Services: We use Google for user authentication and optional integrations such as Google Tasks and Google Calendar. Connecting your Google account is subject to Google's Terms of Service and Privacy Policy.

Firebase (Google Cloud): Lunar Guide is built on Google's Firebase platform for database, cloud storage, and hosting. Your data is stored on Firebase's servers under Google's security infrastructure.

OpenAI and Anthropic (AI Services): Our Spirit Guide feature relies on AI models from OpenAI and Anthropic. When you use the Spirit Guide, your text input is sent to these providers. Use of these features signifies your agreement with their terms of service for the processing of your content.

Eleven Labs: We use Eleven Labs for voice processing features (text-to-speech, voice AI). Only minimum necessary data is shared for the purpose of providing the feature.

Stripe: All payments are processed via Stripe. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your sensitive payment details.

Analytics and Tracking Tools: We utilize Google Analytics, Microsoft Clarity, and advertising pixels (Facebook, TikTok, Instagram, Snapchat) to understand app usage and support our marketing efforts.

We carefully select our third-party partners and share only the minimum necessary data with them. However, we do not control these third-party services and are not liable for issues or liabilities arising from them. We encourage you to review the privacy policies and terms of service of our third-party providers.

11. Email Communications and Marketing

By creating an account, you consent to receive operational emails (account verification, password recovery, purchase confirmations, security alerts, and support responses). These are necessary for the service and cannot be opted out of while you maintain an account.

Promotional Emails: We may send newsletters, feature announcements, and special offers with your consent. Each marketing email includes an "Unsubscribe" link. You may also adjust preferences in app settings or contact support@lunarguideapp.com to be removed from marketing lists.

Third-Party Marketing: We will not share your email with third-party marketers without your explicit consent.

12. Limitation of Liability

12.1. Exclusion of Indirect Damages

To the fullest extent permitted by applicable law, 1117 Productions LLC, Chi Alexander, and our respective officers, directors, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of (or inability to use) the Lunar Guide app or any App Content. This includes but is not limited to:

Loss, deletion, or damage to your voice recordings, journal entries, or other data.
Lost business, opportunities, revenue, profits, or anticipated savings.
Service interruptions, downtime, bugs, or viruses transmitted through or by our service or third parties.
Conduct or content of any third party, including third-party applications integrated with the app.
Decisions or actions you take in reliance on astrological guidance or AI-generated content from the app.
Any harm arising from your reliance on AI-generated outputs (see Section 6.2).

These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

12.2. Aggregate Liability Cap

To the fullest extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the app — whether based on contract, tort, statute, strict liability, or any other theory — shall not exceed the greater of: (a) the total amount you paid to 1117 Productions LLC in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) fifty U.S. dollars ($50.00).

This cap applies cumulatively to all claims and is not per-claim.

12.3. Essential Basis of Bargain

You acknowledge that the limitations of liability in this Section 12 reflect a reasonable allocation of risk and are an essential element of the basis of the bargain between us. Without these limitations, we would not be able to provide the service at the prices offered.

12.4. Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, some or all of the above limitations may not apply to you, and our liability will be limited to the greatest extent permitted by law.

13. Service Availability and Changes

We strive to provide a reliable service, but we do not guarantee that the Lunar Guide app will be available 100% of the time or free from errors or interruptions.

Downtime and Maintenance: The app may be unavailable due to scheduled maintenance or unforeseen technical issues. We will attempt to schedule maintenance during low-usage times and notify users in advance where possible.

No Liability for Interruptions: We shall not be liable for losses or inconvenience suffered due to downtime, slow performance, or errors, including issues originating from third-party providers (e.g., Firebase, OpenAI outages).

Feature Changes: We reserve the right to change, suspend, or discontinue any aspect of the app at any time, including altering features, imposing usage limits, or terminating the app entirely. We will endeavor to notify users of major changes that significantly affect their use.

Beta Features: Features labeled "beta" or "experimental" are provided on an as-is basis for testing and feedback and may be changed, suspended, or removed at our discretion.

Your continued use of the app after any changes indicates acceptance of those changes.

14. Governing Law and Jurisdiction

Jurisdiction: Except where arbitration is required, you agree that any legal actions or proceedings related to these Terms will be filed and conducted in the state or federal courts located in Salt Lake County, Utah, USA. You consent and submit to the personal jurisdiction of such courts.

International Use: We make no representation that the app or its content is appropriate or available in locations outside the United States. If you access the app from outside the U.S., you do so at your own initiative and are responsible for compliance with any applicable local laws.

Statute of Limitations: Any claim or cause of action arising out of or related to use of the app or these Terms must be filed within one (1) year after such claim arose, or it shall be forever barred. This limitation may not apply in jurisdictions that prohibit such contractual limitations, in which case it shall apply to the maximum extent permitted by law.

We may update or modify these Terms from time to time. When we do, we will revise the "Effective Date" at the top. For significant changes, we will make reasonable efforts to notify you by posting a notice within the app, on our website, or by emailing the address associated with your account at least 30 days before the change takes effect where required by law.

Acceptance of Changes: By continuing to use the Lunar Guide app after the updated Terms have been posted and any applicable notice period has passed, you agree to be bound by the revised Terms. If you do not agree to any changes, you must stop using the app.

16. General Provisions

16.1. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any additional guidelines or rules posted in the app, constitute the entire agreement between you and 1117 Productions LLC regarding the use of Lunar Guide and supersede all prior agreements, representations, communications, and understandings between you and us relating to the app, whether oral or written.

16.2. Severability

If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable under applicable law, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the remaining provisions of these Terms shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect any other provision.

16.3. Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of 1117 Productions LLC. No waiver of any breach or default shall constitute a waiver of any subsequent breach or default, whether of the same or a different kind.

16.4. Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. Any attempted assignment in violation of this Section is void. We may assign or transfer these Terms, or any of our rights or obligations, without restriction, including in connection with a merger, acquisition, corporate restructuring, or sale of all or substantially all of our assets. These Terms inure to the benefit of and are binding upon the parties' respective permitted successors and assigns.

16.5. No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and 1117 Productions LLC.

16.6. Force Majeure

We will not be liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including natural disasters, pandemics, acts of government, war, terrorism, internet service disruptions, or failures of third-party service providers.
